Terms and Conditions of the Dale QR incentive!
1). Adherence to Terms and Conditions. The user of public transport services (hereinafter “user”) of buses, Metro and Central Alameda-Nos Train of the Public Transport System of the Province of Santiago and the communes of San Bernardo and Puente Alto, or the communes in which this service is extended, (hereinafter “the System”), a natural person, who has enabled the form of payment with ABT transport accounts (bip! QR and QR Ticket, or others that may be incorporated in the future), and makes your payment through these mechanisms, through the Red Movilidad Application (App Red) and the Banco Estado Application (App Banco Estado), or other applications that may be implemented in the future (hereinafter “the App”), fully accepts these Terms and Conditions for the use of the incentive called Dale QR! in Mobility Network.
These Terms and Conditions are established from the regulation of the activity of users to access the Dale QR! in accordance with current legal regulations. In consideration of the full acceptance of these terms and conditions, users fully and unconditionally undertake to comply with all clauses, conditions, warnings and these Terms and Conditions.
Before entering, using and/or registering in the Apps, in order to access the incentive, the user must carefully read these Terms and Conditions. The user’s ignorance of these Terms and Conditions does not exempt him, under any circumstances, from the non-application of the provisions contained herein.
2). People who can access the incentive. The Dale QR incentive! will be applied exclusively to people who make the payment of the adult fare through ABT accounts enabled in the App, so this incentive will not be valid for various Means of Access, such as the bip! card.
By fully accepting these Terms and Conditions, users will be automatically registered in the “Registry of Users” regulated in article 88 bis of DFL No. 1, of 2007, of the Ministries of Transport and Telecommunications and Justice, which establishes the consolidated, coordinated and systematized text of the Traffic Law (hereinafter “Traffic Law”). as set forth herein. Those who are not in the aforementioned User Registry will not be able to access this incentive.
3). Give it QR!. The Dale QR incentive is awarded! to all users who make the payment of the adult fare for access to the System, through ABT transport accounts enabled in the App. During each calendar month, a maximum charge of $38,000 (thirty-eight thousand Chilean pesos) will be applied, or the amount resulting from its adjustment or from the update determined by the Ministry of Transport and Telecommunications (“MTT” or “Ministry”). Once this amount is reached, you will be able to access rides at no additional cost until the end of the respective month (Dale QR is activated!), that is, in the same calendar month. That means that, once the $38,000 (thirty-eight thousand Chilean pesos) has been reached, or the amount resulting from its adjustment or the update determined by the Ministry, and for the remainder of the month, the validation of the trip will have a cost of $0.- (zero peso). The regular rate will be charged again once the next calendar month begins, until the maximum value indicated is reached, and so on.
The Apps will indicate if the user’s account is accumulating for the activation of the incentive or if the incentive is active. The incentive will be activated once $38,000 (thirty-eight thousand Chilean pesos) is reached, or the amount resulting from its adjustment or the update determined by the Ministry.
4). Duration of the incentive and very personal nature. The accumulation and incentive will have the duration of the corresponding calendar month, starting on the first day of the respective month and ending on the last day, that is, the 28th, 29th, 30th or 31st, as applicable.
The use of ABT accounts is personal and non-transferable. From the second validation, which is successive in the same validator of the bus, the Metro station or the Train station, these will not be considered for the accumulation of uses of activation of the incentive, nor will they be affected by the incentive once the amount has been reached (so they must be paid).
In the event that the user performs any type of enrollment or re-enrollment, except if it is done from the same mobile phone, the accumulated amount to access the incentive will be reset (it will return to $0.- (zero peso)). Enrollment is understood as the process that allows individuals to enable their ABT account.
5). Obligations of the User. Once the Dale QR! incentive is activated, the user must continue to validate with their “QR code” when using public transport services, whether bus, Metro or Alameda-Nos Central Train. The user who uses the beep! QR must have at least a balance equivalent to the value of the adult bus fare, in order to generate a “QR code”.
The user will be solely responsible for all the activities that he/she carries out or occur in the Apps installed on a given mobile device and for which he/she is duly enrolled.
6). Restrictions and misuse. The person who, having the incentive in force, carries out successive validations in the same validator on the bus, in the Metro station and in the Train station will be valued normally and will be charged to the respective account.
The MTT reserves the right to report to the competent bodies any misuse or malicious use of the incentive, such as those tending to generate or promote payment evasion, fraud or damage to third parties, this infraction being cause for immediate termination of the incentive.
7). Technical conditions. The control and application of the incentive will be carried out during the night valuation process, considering the transactions correctly received by the Central System, managed by the System’s technological service provider, until 9:00 p.m., so that, in this case, the user will see the application of the incentive reflected the day after having received and valued the transactions for the use of the payment mechanisms in the Central System. The user will be able to view their validations carried out and received in the Central System on the http://pocae.tstgo.cl/PortalCAE-WAR-MODULE/ website .
The Ministry reserves the right to carry out various controls focused on ensuring the proper use of the incentive.
The new enrollments will assume by default the predetermined rate for obtaining the incentive ($38,000.- or that resulting from its adjustment or the update determined by the Ministry), and cannot be considered proportional amounts for obtaining the benefit, that is, regardless of the day of the month in which the enrollment was made, as it is a monthly incentive (calendar month).
8). User Registration. In accordance with the provisions of Article 88 bis of the Traffic Law, the purposes of this registry are to ensure the correct granting of the benefits derived from the use of public transport, to verify the improper use of mechanisms or instruments of access to public transport and to verify the frequent use of public transport by users. as well as for statistical purposes that could serve as a basis for the development of public policies associated with paid public passenger transport.
9). Disclaimer. The MTT is not responsible in any way for the use that the user makes with respect to the Dale QR! incentive, fully and expressly releasing itself from any liability, whether civil, commercial, administrative, sanctioning, tax, criminal or of any other nature, that may be generated. The user expressly consents to and accepts this release of liability.
The user is liable for damages of any kind, direct or indirect, that the MTT, other users or third parties may suffer as a result of the infringement, by the user, of any of the terms to which the user is bound by these Terms and Conditions of Use or of the applicable regulations in force.
10). Privacy and Personal Data Protection Policy regarding User Registration. In accordance with the provisions of the Traffic Law, the processing of the personal data contained in the User Registry will be carried out in an appropriate and pertinent manner, in accordance with its purposes. The information contained in this register is reserved, in accordance with the second paragraph of Article 8 of the Political Constitution of the Republic, since its publication affects the rights of individuals. However, the owners of the data recorded in the Registry may access them free of charge and exercise the other rights established in Law No. 19,628, on the Protection of Private Life.
In the event of requests for information in accordance with the provisions of Article 1 of Law No. 20,285, on access to public information, the personal data of the User Registry that are required in such requests will be protected by the grounds for confidentiality established in numeral 2 of Article 21 of said legal body.
11). Applicable law and jurisdiction. For all purposes derived from this instrument and the relationship with users, they are governed by Chilean law, and the ordinary courts of justice with jurisdiction in the commune of Santiago will be competent to resolve any controversy related to these Terms and Conditions.
12). Validity. These Terms and Conditions are effective as of September 1, 2023.
13). Modifications. The MTT reserves the right to unilaterally modify, at any time and without prior notice, the Terms and Conditions established in this Annex, which will be published on the www.red.cl website and on the respective platforms, leaving a record of the previous versions.”
